1. GENERAL TRANSPORT CONDITIONS
The company Taxi Radio Bruxellois SA is a telephone exchange, which means that it connects a carrier (member) with a customer.
Taxi Radio Bruxellois specialises in the transport of persons and express road transport of letters and small parcels.
Our prices are quoted inclusive of VAT.
Any complaint concerning prices must be submitted within eight days of the date of the invoice. The principal shall at all times be liable for the payment, even if he has issued to us the order to collect the price of the transport from the addressee or from any other third party. The price of the transport does not include any and all ancillary costs and charges, storage, etc. with no reservations or exceptions.
Our invoices are payable in cash and bear interest ipso jure at the legal rate plus 2%. In the event of non-payment after formal notice, 15% of the amount invoiced shall also be payable as a lump sum indemnity with a minimum of € 50 to cover commercial damages and administrative costs.
1.2.2 Special conditions related to customers not showing at the pick-up address and time
In case of absence at the pick-up address, whether the customer has requested the ride or just benefits from it, either at the arrival of the taxi for immediate orders or at the booking time for orders in advance, the driver will wait for a maximum duration of 5 minutes. When this time limit expires, the driver is free to close the ride and declare a “client no show”. In this case, fees up to 5€ can be charged by Taxis Verts to the customer who requested the ride, especially in-app payments through the Taxis Verts mobile app. This fee is meant to compensate the driver for the loss of time and mileage.
In case of a complaint to Taxis Verts to deny the absence, the customer service will analyse the eligibilty of the request based on the Taxis Verts rides data.
1.2.3 Special conditions about fixed guaranteed price
The estimated ride fare is indicated in the form of a price range in the app before ordering. This estimate is based on normal traffic conditions and doesn’t take into account the risks likely to significantly increase the duration of the ride. It doesn’t constitute in any case a commitment of Taxis Verts.
To avoid these risks, Taxis Verts offers a service called “fixed guaranteed prices” allowing you to benefit from a guaranteed price. Acceptance of the use of the “fixed guaranteed price” service will result in your agreement on the proposed price, as Taxis Verts will be responsible for any difference between the fixed guaranteed price and the taximeter price, as part of its booking intermediary service.
The fixed guaranteed price can not be applied in the following cases:
– The driver waits more than 5 minutes before leaving the pick-up point
– Additional waiting time requested during the ride
– Change of destination requested during the ride
– Detour requested during the ride
In these different cases, the price to pay will be the one indicated on the taximeter at the end of the ride.
1.2.4 Particular conditions relating to our taxi and delivery vouchers (chèques)
Cheque debit order forms are used only for payment to drivers of trips by taxi or the transport of parcels or mail ordered through our services. They may not under any circumstances be used for loans and no change may be given in return. The entry only of the amounts to be debited shall suffice as proof, and the order need not necessarily be signed. It may be used for any carrier. The affiliate remains liable for the use of cheques entrusted to him, even in the event of loss or theft. Cheque statements are payable in cash upon receipt, whatever the amounts and periodicities. New books of order forms may be issued only after the payment of outstanding statements, and we reserve the right to review the amount to be issued without having to give reasons. The deposit paid, which does not bear interest, may not under any circumstances be used for the settlement of accounts, except in case of termination, which shall entail the immediate handing-over of any remaining blank forms. The T.R.B. reserves the right to terminate the affiliation at any time without giving reasons, but refunding the deposit or the balance thereof in the event of non-payment. If the affiliation is terminated, the affiliate undertakes not only to cease to use the cheques still in his possession, but also to return them immediately to the T.R.B. by registered delivery. The T.R.B. shall be entitled to charge a contribution of 2.5% of the amount of the statements with a minimum lump sum of €15 for invoicing costs.
1.2.5 Particular conditions for the transport of objects
Each parcel or envelope shall be legibly labelled and shall give the full particulars of the sender and of the addressee. We refuse to transport cash, securities, valuables such as precious stones, jewellery, etc. as well as any dangerous goods. The goods shall be packed by our customers so they can withstand the normal handling and transport operations taking into account their nature. It is impossible for us to check the condition of the goods when they are picked up.
Our liability is determined by the CMR Convention (Belgian law of 4 September 1962) and its additional protocols. Whatever the contractual nature of our intervention, the maximum indemnity payable by our company in the event of liability shall be 8.33 SDR per kg gross weight of missing or damaged goods. No indemnity shall be payable for any harm suffered as a result of the unavailability and/or loss of clientele and/or any indirect losses.
184.108.40.206 Optional comprehensive insurance
Our company has taken out a floating “comprehensive” policy for goods. This optional insurance policy is available to our customers at their express request and against payment of the premium to be determined on the basis of the risk incurred and the declared value.
Acceptance of this insurance policy creates for the benefit of our customers a direct legal link with the insurer. If our customers wish to take out a separate insurance policy for the goods, this insurance policy shall contain a clause giving a waiver of claims against our company.
1.2.6 Complaint tracking
If the customer is not satisfied with the way in which his/her transport is administered, he/she may contact the Customer Service via the online form so that Taxis Verts can conduct an inquiry as quickly as possible.
In the event of an unjustified complaint, Taxis Verts reserves the right to charge the costs incurred to the complainant.
If Taxis Verts cannot effectively respond to a Customer complaint through its internal complaint procedures, the Customer may contact the Mediation Service for the postal sector at the following address: Rue Royale 97 box 14 at B-1000 Brussels, or by e-mail at firstname.lastname@example.org.
1.2.7 Damaging the vehicle and/or leaving it in a dirty state
If the vehicle has been soiled for whatever reason, a minimum fee of € 150.00 will be charged to the Passenger(s). This charge must be paid at the end of the journey directly to the driver. This charge covers the cleaning itself and the loss of income during the cleaning process. Should the cleaning and/or repair costs exceed the minimum fee, the Passenger(s) will be liable for the total costs. Next to the repair costs Passenger(s) will also be charged for the time and cost of the vehicle being out of operation. In such a case, the hourly fee that will be charged to the Passenger(s) equals the current hourly waiting fee as defined by the Brussels Capital-Region.
1.2.8 Jurisdiction clause
Any dispute shall be governed exclusively by the courts of Brussels.
